It is administered through an online system developed by the Ministry of Micro, Small and Medium Enterprises, whereby eligible business entities are allotted a unique Udyam Registration Number (URN) along with a digital registration certificate. This registration functions as a statutory identification mechanism for MSMEs and enables such entities to avail themselves of various governmental benefits, including subsidies, incentives, priority sector lending, and other policy support measures. From a legal perspective, although Udyam Registration is primarily a civil and regulatory compliance mechanism, any misuse thereof—such as furnishing false or misleading information, obtaining registration through fraudulent means, or misrepresenting investment or turnover—may attract penal consequences. In such cases, proceedings may be initiated under the relevant provisions of the Bharatiya Nyaya Sanhita, 2023, while the procedure relating to investigation, inquiry, and trial shall be governed by the Bharatiya Nagarik Suraksha Sanhita, 2023. For instance: • Submission of false declarations for the purpose of obtaining Udyam Registration may constitute offences such as cheating, forgery, or fraud. • Any complaint arising from such acts may result in the registration of a First Information Report (FIR), followed by investigation by the competent authorities and subsequent trial in accordance with the provisions of BNSS. Thus, although Udyam Registration is administrative in nature, it may acquire legal significance in situations involving criminal misconduct, where the procedural framework of BNSS becomes applicable.
