It includes procedures relating to visa issuance, registration, regulation of residence, monitoring of stay, and deportation of foreign nationals, in exercise of the sovereign authority of the State over its borders.
In the context of the Bharatiya Nagarik Suraksha Sanhita, 2023, immigration is not directly or substantively regulated, as the BNSS is a procedural statute governing the administration of criminal justice in India. However, its provisions become applicable where violations of immigration laws give rise to criminal liability or enforcement proceedings. The BNSS lays down the procedural framework for investigation, arrest, detention, inquiry, and trial of offences committed by foreign nationals, including those relating to illegal entry, unauthorized stay (overstay), use of forged or invalid travel documents, or breach of visa conditions.
Authorities empowered under immigration and foreigner-related laws—such as immigration officers, police authorities, and other designated government agencies—are competent to initiate action against persons found in contravention of applicable legal provisions. In such instances, the procedural safeguards and mechanisms under the BNSS, including provisions relating to cognizable and non-cognizable offences, registration of information, bail, remand, and trial before competent courts, are attracted to ensure adherence to due process of law.
Further, the BNSS facilitates coordination between law enforcement agencies and the judiciary in handling cases involving foreign nationals, particularly in matters relating to jurisdiction, service of summons, production before courts, and custody management. It also operates in aid of administrative measures such as detention pending deportation or repatriation, subject to compliance with constitutional guarantees and judicial oversight.
Thus, while immigration per se falls within the domain of specialized substantive laws and executive regulation, the BNSS functions as a crucial procedural instrument in addressing the criminal and enforcement aspects arising from immigration violations, ensuring that such actions are conducted in accordance with established principles of criminal justice, fairness, and the rule of law.
